Helge B. is a key witness in the trial against Christian B., who is also a suspect in the Madeleine McCann case, the most famous missing persons case in Europe, which has been ongoing at Braunschweig Regional Court since February. He is the one who, together with a friend, claims to have seen the videos on which Christian B. is said to have recorded the rape of two women in Portugal. A second video showed a younger woman tied to a pole in Christian B.'s house. "Hey Christian, this is rape," she said in the video. He knew then what was coming, says Helge B. The videos have disappeared, B. no longer knows where in Portugal they were lost, so it depends on his statement. Christian B. sits a good five metres away, between his lawyers, outwardly unmoved.

with such pieces you get a bit better idea of what happened in court, but they are rare to find. at least the citations that are out in other articles seems the same, but usually you get a lot less.
and as we already have seen and read a lot more it is hard to get an idea if it was said in the same way during court too.

but they could have offered transcripts, certainly because it is only by the german law, these cases end up in a german court, but the interested public is mostly from other countries. and always better to make use of a transcript for translating too, you miss out on refrasing to the level of the readers and users of a specific publication.

even a good long read of each week of court would be very welcome. and it never was very popular in germany, so i can understand they do not even invest much hours in it. even in the uk titles i need most times their search engine to pick the pieces up early.

and that is something to expect too, for most it is just still that link to cb under suspicion for the madeleine case that is of interest, and after 17 years that is all together still quite a larger group, but nowhere near what it was, but for who is still interested the internet serves you well of course by just select it for you. so there is still a fake idea the case lives on, and that means around cb too of course. so it just looks busy in the madeleine bubble, even on social media it are just a smaller number of names you see time after time.

and the madeleine case and now this intermezzo with cb, and even the julia affaire at the moment, you see directly a lot of strange effects walking in mostly just to stir a pot, that needs filling with gold, at least they hope for that to happen.

but you see hardly much true investigative journalists invest in the madeleine case, maybe because there is also a lot of oppression about what opinion they have to agree on. so it is just do it with what gets out.

Sorry folks, they don't have any evidence to connect Brueckner with the disappearance of Madeleine McCann.  If, like they suggest, they have compelling evidence of abduction and murder what are they waiting for .... Armageddon?  Desperately trying to fit him up with accusations never substantiated is fish fry compared to the later story line.  We've been this way so many times before, it was a load of rubbish then and it's a load of rubbish now, it hasn't even really stuck in isolation - still the press and media (that includes social media) are dragging up old names from the past to re-add to the mix.  People forget, or don't even care what they've seen or read in he past just as long as there is another story out there to make mischief.

but it is a nice example of at least someone who did his best to write something from the court, and it is even strange to call it nice, because actually this is why we need the media, you know that ugly thing of informing the public. we all can understand that such impressions can easily have a slip in of some bias, but i am okay with that, i prefer pieces without it, but most written about this side chapter in the book of case notes of madeleine is very much let down.

From my personal experience google works the same wherever you are in the world - only difference being the language. Go to google dot whatever domain, type Christian Brueckner in search by example and you will get the same results but with the language option.

It's looking for specifics that has been confounded by AI.

That aside, experience tells me there are two main types of serious journalism - that which comes from a central press agency which is distributed throughout the world of press and media and that produced by the individual journalist, usually under the feigned opinionated 'investigative journalist' name.

Either way in my opinion not to be entirely trusted, the former being distributed for the press and media to put their own individual slant and the latter, the investigative journalist, who invariably has their own preconceived slant written in every line. In short, they don't report verbatim but more a generalised 'entertaining' slant on proceedings.

THE judges who quashed the arrest warrant for Madeleine McCann suspect Christian Brueckner have been accused of bias by prosecutors.

Three judges at Braunschweig court in Germany sensationally ruled this week that the arrest of the paedophile that led to his multiple sex crimes trial was unlawful due to ‘a lack of credible evidence’.

It raised the prospect of the cases being thrown out and of Brueckner being released into the public within months.

The decision sparked fury among witnesses in the trial who said they had spent years of their lives trying to bring the predator to justice.

But in a court press release, seen by the Olive Press, prosecutors are demanding the three judges be recused due to alleged bias.

It reads: “The Braunschweig public prosecutor’s office has filed a motion to recuse the three professional judges of the 2nd Criminal Division due to concerns of bias.

“If the Chamber considers the motion to be admissible, the responsible representative chamber will decide on the question of bias by the next day of the hearing on August 5, 2024.”

The court case meanwhile continued this morning hearing from more witnesses and specialists.

In particular the judges heard from an eye specialist about whether victims can recognise their attackers just from their eyes.

It came after Irish rape victim Hazel Behan claimed she is certain that Christian Bruckner was her attacker in 2004 after recognising his piercing blue eyes.

The doctor sensationally told the court that Hazel was ‘in the right’ and it was possible.

Angering Brueckner’s lawyer Friedrich Fulscher, he explained that it is possible, to remember blue eyes, ‘even in near darkness’. No other colour is possible.

A number of other witnesses who were close to Behan at the time of the attack on the Algarve were also due to be heard this morning.

i can only use google.nl still you have to manhandle it a bit to get news from germany, the uk and france too, but usually i am too lazy, so i just use the translated search terms. it changed years ago, i had google.com, what would gave a much larger response, with even the news about something from spain and italy and the usa too in one go. we simply get less.

that what is it called alert feature? only gives the big ones, and they are never very quick or correct. and i would only get the dutch and flemish ones too, usually days to months old nicked stuff.

around noon, there had already been 63 news outlets having it in germany, mostly just the same sources. the email to the press abo from the german prosecution had 10.51 for the first.

this courts end at friday between 12.00 and 13.00 hours, so i just set my search terms ready and use the tools to get all from the last hour. on other court days i do it just twice one for lunckbreak and one for the early evening.

and it works nowadays already very different from the earlier versions of google.com, that did not mind about the search term as long as it was given in english, it just would plow the internet for all languages, that is sadly long gone. must be the age, most would get a bit lazier when growing old.
but it was great when it started, we had all these dutch small search engines, and at that time you could only open one at the time, iris i remember, and one that was named after our queen at that time. even using a phone book with the yellow pages was still quicker.

the problem is that there are many christian b. figures and even christian brückner, or spelled as brueckner are not very unique at all. and combining it with madeleine mccann grabs only half of the german stuff, because they use often fall maddie as the case name. and within german territory there is no christian brueckner in any news, only the christian b.
but google does learn what you want, so that works fine enough for me after some time.

and the german news is a bit better and quicker too. i have nothing with the sun, the daily mail, most times only the mirror is the more early one, but only when you use the search bar there on.

so by doing it just on my own mind and fingers i can escape the ai thing i think. it works better for me, and this case is easy stuff to find. i am used to silly questions as finding a feed merchant that sells specific stuff near some little village in kenia or tunesia. and for such things is still works well and quickly. i even work for client assets that say always ia. at feeding time of course. it is the only form i know that works always.

The hobbled drifter was in visible pain - just a week after being wheeled into court in a wheelchair amid conflicting reports of an ankle injury suffered at JVA Sehnde prison, near Hannover.

Brueckner has been held in solitary confinement at the jail and his lawyers have not go into detail about his injury in court.

They had been expected to discuss the revoked warrant paving the way for Brueckner’s terrifying release - but were halted by a judge who refused to let the trial be distracted.

The judge blasted: “Any interruption of the main hearing would delay the main case.”

On Wednesday the court announced it no longer held “urgent suspicion” that Brueckner committed the crimes he is currently on trial for - and which are not connected to the McCann case.

They revoked his arrest warrant meaning he is no longer being held for the alleged rapes he is on trial for.

He is still behind bars, however, as part of the seven-year sentence he was hit with in 2019 after being convicted of rape.

It means he could be free for good in a matter of months if he is found not guilty in the current trial - and back on the streets even sooner.

Maddie disappeared in Praia da Luz on Portugal’s Algarve coast in 2007 while on holiday with parents Kate and Gerry, of Rothley, Leics.

Day-release is a right for prisoners in Germany approaching the end of their sentence.

Prosecutors can try and keep him behind bars by finally charging him over the disappearance of Maddie - which he has been the prime suspect for since 2020.

Brueckner denies three counts of rape and indecent exposure claims at Braunschweig Regional Court.

Just weeks ago detectives discovered an email account linking Brueckner to the death of Maddie McCann.

Detective Titus Stampa told a court the German FBI had identified two email accounts linked to the paedophile.

But Stampa said he had no clearance to discuss it because it was “related to the killing” of the tot.

first things first, it still was an active court day, and we had at least the optometrist in.
but it will lean heavy on the source you read, what the outcome is.

you can go for nicely short as the dutch would say from the olive press;

but did he really say that in court?

or most dpa source users in germany have something like;

The background to this is the case of an Irish woman who was raped in Portugal in 2004. As a witness, she had reported "piercing blue eyes". "His eyes, I think this man is the attacker," she told the court. The defence considered recognition based solely on the colour of the eyes to be impossible. The expert witness had also said that there were no differences in the perception of eye colours: "Blue is blue." Pungent or bright blue eyes are from the realm of poetry.

so my impression if that was said is different, hazel b still could have seen a male figure, at least male by going from other parts present, with blue eyes, but it is just blue eyes are blue eyes, independent of its owner when it is about a specific set of them. so the set of blue eyes of cb could not be different from any other male with a pair of blue eyes.

the eyes who are described during the trial in the 2005 rape case by the victim there had been dark eyes.

so together, there is already a difference possible in eye colour, if blue it is not in itself an unique enough feature for identification by the human observation, counting with the lack of a unknown thing, that could be a scar, tattoo, something in the tights, or just a clump of unknown substance, on the right upper leg-hip region, that cb supposedly has not. there was a check done months ago to establish that already.
the mostly uk reporting side changed it in a soaring story about a birthmark taken of cb in a medical setting from his left upper leg. what was poppycock of course hazel b never stated anything about the left leg or hip region, only the right side.

now hazel b stated in court she could recognise cb his blue eyes, the expert witness seems to agree with her, that even if it was in a near dark setting blue eyes could be recognised as being blue, if it was most likely or stronger given by the expert-witness opinion, and i do not expect that from an expert witness, we are very fond of keeping at least a 1% gap for margins, but there was no agreement on piercing eyes, what going by the second source was just a kind of impression by our emotional fantasy, what he called poetry.

so that is not the same as being in agreement to hazel b her words.

and it simply does not work if the reporting style is used to mislead others in the public. and usually it is simply done by taking the spoken words out of the full context.

because looking at multiple sources there was only a partly agreement on the eye colour and recognition under near dark conditions, but that did not answer the question of the defence and why the expert-witness was asked into the court.

the question was simply if you would be able to select a specific set of blue eyes from other pairs of blue eyes as being a way to identify cb as the owner of this pair of blue eyes. and i do not think that was concluded in the expert opinion, but i need a lot more snippets to get there.

and i do need an expert opinion for this, i never forget a face, but my mind does not store them in a way i can single out parts of it, i can not zoom in on separate features, and i learned from this case and many others before that i do not look often with so much attention that i make up my mind about the eye colour.
people around me know that very well, and would never ask to give a description in features of a person, maybe because i tried for a very long time, if i could learn that differently, i do not agree that ‘blue is blue’ for eyes.

also it could be when it is about blue colours, and all from pinkish to purple with blue in the middle, and also all blue green tones, be better to not ask such questions to people who have a y chromosome.
they are very known as being less able to distinguish in colour tones with a blue based tone in it.

blue eyes as a group definition is indeed as simple as blue is blue, but there are a lot of different colour tones in that blue possible, and often very hard to name them, and i am from a country that has a quite large representation of blue eyed people and we like the no nonsense approach maybe a bit to much, if you want a passport it was only possible to choose from blue, green and brown. the picture in a passport or later id cards is not large enough to truly see what eye colour most have. my own eyes are on paper simply blue, but i have dual coloured eyes, other near family has too, but with green as a base colour. it has even very different genetic reasons behind it, mine is still unknown, the other is known.
but no pair of blue based eyes are equal in my family. There is simply no standard for how a blue eye colour looks. They all show as a tone of blue, only not the same blue in many cases.

all i can say from my own observations is that indeed usually you can still make out if eyes are light or dark coloured, but the differentiation between grey, green and blue can be dependent on light conditions. this is something you do not need to be an expert on, you can study it yourself as long as you have multiple people around you, with also different basic eye colours of course.

my own eyes always show a light colour with a blue tone in it, but in morning light the outher sphere looks grey in tone and the middle sphere looks very light almost creamy brown. but walk out of direct light and the light grey tone changes to a light blue tone, and the inner sphere into a hazelnut brown.
and that is the problem, it are simply my observations about colour tones.

it is not emotional or hormonal or fantastical, just an observation in different conditions. and your own background and experience in working with colours and if you are male or female can make it very different.

in this case i did not found a name for the expert-witness, quite unusual, because your name can be used to look into the background of your field of expertises. optometrics is just all that has to do with measuring what eyes can see, what medical difficulties play a role in that and if there are solutions to that, and who can deal with that. i have nothing to look deeper into, to form an opinion if this was the correct expert to give a expert opinion, and i am now almost a day later forming the idea if this truly was the right guy for answering the question that was raised in court.

the question was not could you recognise blue eyes in all conditions as blue eyes, and it seems that he gave a positive answer to that question.

but he did also discredited hazels observation of piercing eyes, the colour or colour tone itself is not functional in that, as belonging to the world of poetry, the fantasy kind of that most likely.

but that was not the question, the question in court is raised as can hazel b. be able to recognise the blue eyes she remembers from her attacker as being the same or at least equal as the ones of cb has now. what translates to can a human use a selection from memory on a specific set of eyes alone.

the colour blue is not that important, because hazel has observed blue eyes and cb also has blue eyes, so there is no dispute at all in that part, it is only the question of both are indeed the same eyes and if a human being, in this case hazel, being able to tell 20 year later if both pairs of eyes are the same, and by that belonging to the same guy. this is all about identification.

my doubt here is if an optometrist indeed can have the needed expertise to answer that question. with a name you can look up if it is a so called super specialist, but with lack thereof it is doubtful if this is the expert that is needed.

and if the words we get from the media are the results, i expect both the defence and the prosecution must know this answers no question at all, and it was just spoiled court time.

and it is nice to explain a bit more about the use of expert witnesses in police investigations and during court. many are very fond of these nice framed certificates that serve as wallpaper, and titles to a name. but a lot of titles are from the basic education, so all medical university ones are usually known as medical doctors, but they have indeed the same basic training and knowledge, but most will still specialise after that, and expert means you know very much of something that in itself is often very small. the same with all other titles from geology to biology and all others.

that basic communal knowledge is not so ‘experty’ at all, you usually know the full field of study in still pretty basic lines. it does not works differently for other occupations most have a name that reflects over the complete field, but not about the true abilities. carpenter, teacher, butcher, it does not define into specific abilities, teacher is maybe the easiest to explain that. there are many teachers with very different fields of teaching, you can simply not just exchange one for the other. teaching german ask for very different competences than teaching chinese. you can not take for granted the teacher of german can teach chinese too.

with the expert-witnesses, most will have a higher education in their field of knowledge, but in these groups working the full field can have large differences.

optometrist is in my country not a university study, but a more practical higher practical education that is seen as equal to bachelor in university studies.
most work in the field of testing eyesight, often in shops, but who also screen for abnormalities that could ask the need of being seen by a real eye doctor. they are not medical doctors or trained as one. they are mostly part of first line health care options, specialised in eye health scoring and eyesight.

but working with eyes does not mean you have expertise in all aspects, and i think this testimony needs to be stricken from the case, it does no right to the victim witness and the defendant at all.

another thing to this part of the testimony that also plays a role in the beach case, is the use of full face pictures in the media. first in the media it is never to know or be sure you see an original picture, and in this case it is even easy to check out by yourself, use google pictures and you can see that there are often small and larger differences in colour tones. both the witnesses have made known they do recognise cb from such pictures, the only other time they could see cb in real life was during this process in court, and the portuguese victim is not really known that she indeed was in court or through a video conference option.

also nowadays with using news much more online, the settings on your own device can do a lot in that too.

so it is very hard to look at a picture and still see that as a snapshot of a reality.
there are often many fingers at play before your own mind sees the result.

but even in real time direct meetings like in a line up in an investigation, there are many ways to train the witness.

it is one of the hardest things to get from that first time real experience and observation with another human, to recognise them again.

it is well known that our human minds are easy to train, even without knowing it ourselves and this is a very large problem for witnesses too. pictures and the words with it do influence everything we already know, and usually we not truly know what we do know, and what of that is from our own direct and naked observation, and what is backfilling from our own thoughts and the influences from others.

so it is also the reason why there is so much attention when it is about recognising a defendant. but i think they made a bad choice to ask the expertise of an optometrist in, just too far removed from its field of knowledge. certainly because there seems no way to check anything about the guy at all. i do not like that.

and getting to different answers about the same event is certainly not of help to understand the case at all. it never does, so i hope that all 3 parties ask to throw this expert witness out of this trial. this simply does not work at all.

state of the trial.

the trial about the 5 cases will still go on, the arrest that is acquitted is not effective to break the cases in itself to a full acquittal of the charges.

the judge team has all the charges and files from the prosecution,
and the judges have the role to research if the accusations are legally sound.

this means that from the start there are no secrets between what the prosecution brings on, and the team of judges, the schöffen usually have no full insight to the files, but on a as needed base.

but the hearing in court is to give the defendant an entry to oppose or rectify all that is in the accusations. the defence team also has the full insight in the prosecution files as soon as charges are brought to a defendants name.

so if you want to call what still can have secrets that is on the defence side. a lot is usually already known from their list of witnesses they want to make use of, but they always have the right to react to all the prosecution brings on. there is no obligation to hand in all files from the defence side because that would be

the hearing of a case in court is also needed so the media as the fourth force of power can control the state= prosecution, and the court, and also the public can take part in seeing all is handled by the law.

based on what is become known outside the courts i can agree on that.

i can see the prosecution is not happy with that outcome, but if you work there, you know the risk, and it just implicates you did not do your job well enough.

also from other presentations around the defendant cb in the media, you can easily see there are other motives at play at the prosecution side than seeking justice in these 5 cases itself. and that is not within the meaning of the law usually.

there is no need to call it a fight with technicalities rubbish from the defence, the rules are well known by all parties, and the risk of being sloppy with the law are too.
and the defence team is there to see the proceeding of law is handled correctly, and why they are paid for it.

also challenging the judges, all 3 of them is a much harsher technicality the prosecution asks now, than all others together from the defence side.

the no longer upholding of the arrest warrant does not make a difference in the circumstances around this defendant, he will stay in jail on his earlier conviction, so it is not he walks out.

and the result if, and usually is not that easily done to get judges challenged and see it granted, is that the complete case has to be start over again, and that can have at least the same result, or worse because the witnesses can become better trained if that has a profit, so the principle in law for that is usually when there is doubt in such things the defendant has the profit outcome of it. but also it can very well be that the next team of judges simply comes to the same opinion.

the prosecution fears bias in all 3 judges, what is pretty unique. it was hard to see for them the opinion of the court about the motion of the defence granted of course. i would be more worrisome about the 2 suspicions of police corruption, in two separate working parts of the bka. and the box factory razzia history has maybe even multiple layers of corruption in it.
together with how the prosecution connected all in the media to the case of madeleine mccann made it not as the show off of being competent i think.

i do think there are true victims who are used as witnesses in this trial, only it is not okay to let them believe that on the evidence from their words alone this could lead to a sound conviction. none of the persons in the prosecution is a newbie, all of them must be able to see what is out now is very little and does not point by that the finger on that one man in court.

the media made it into a easy case, just a easy walk through the park, court cases are never a done deal. the strong stories about the corrected identification points seems to be simply invalid at best.

i did even read a comment in a german discussion, that hazel only could know about blue eyes, when she had seen cb, because there was always a black bar over the eyes in the pictures or they been pixel-ed out, only people must have missed this only was done at the start in german news, but hardly in all other news with a picture of cb outside germany.
so many in what you read can influence your own opinion, that it becomes even misleading at best.

and it was just a media presentation of the prosecution that with avid help of the media, painted a long list of cases to cb. and most know better, all kind of missing children been put to his name, and of course the police on such cases will look into all who are arrested if their case could be the work of any new possible suspect in other cases.

like the redwood collection, of break-inns with supposedly also an eye or hand to children on holiday accommodations in the algarve. with a little netflix glue they have been put to cb too, still if you look back to the words about these cases the description of a culprit in some excludes cb pretty quickly. i think it deserves its own write up in this series of topics.

now we heard that there are at least 3 other solved cases with the same mo, so it means there is at least one, and maybe even 2 or 3 guys who have been able to attack woman in the similar enough way as the 3 cases of rape in this case.
and it is not that strange, usually just very few facts come out into the public, but that does not equal up to call it a rare mo.
one of the sad reasons for it, and this i know from other offenders, is that there even are so called challenges out on the internet, most only know about the funny ones, but there is a lot of cruelty ones too.

and besides cruelty taken as if it was a sport, there is also a large market for all kind of pornography out there, that also follows with hypes for a genre. what ends up in producers and consumers who use it as an example. it is an existing never ending market of sellers and buyers. and asking buyers and sellers of all that too. a lot is made by consulting adults, and a lot is not.
even helge b thought at first glance he had a video that was simply downloaded from the internet, and in 2006 you did not have to find the dark web for that.

but it is always quite a shock to hear the story of a victim that had no choice in it, you still have a need of facts, circumstances and evidence that can prove who was the offender in that. it is not easy for anyone to learn to set the emotions you will have when you hear the stories of the victims, but there is no other way. and there is after a verdict that ends up in a guilty enough time to point a finger and some bad words to the perpetrator. but even besides older conviction, it has still be each case on their own.

and only in that way you can deliver justice to a victim.

and the real fight to not have to let guys who are already known offenders is not in the court room, the law, rules and regulations are not made there, that is done by a government. i have a lot of bias in that, because i am pretty harsh, i think once is enough to keep them out of a free society. it is a choice to do these things to others. that choice needs a high price.
i never was or will be able to work such cases on the investigation side, but i been many times used as a so called responsible adult, for vulnerable victims, mostly during their first interview. and that was hard enough, and it is very dual in emotions, i worked often in the same places i also lived in myself, and that means you do meet later on unexpected the victims, but also the perpetrators again. what makes it quickly quite difficult, because the victims do not forget me, i do not forget them, or their stories and that is not always welcome and can for a victim even be very confronting too. some found some roots back, a way around to live again, others do not, but the memory itself is not always welcome.

i have spoken later on with some of the victims, and asked them about that. they will never forget, they have life between their ears. it simply is something you cannot talk freely about. for some meeting me on a street brings their memory back in their brain as if it was lightning.

and the thing with knowledge about who has done what, convicted or not, is you cannot unknow that. you are not allowed to make use of the information you have about the bad apples. for a lot it was nice to see my guts worked well, there been little surprises, but why do we take that risk.

My usual go to methods for ducking a paywall don't work with Braunschweiger Zeitung outlet, it's as well they have nothing to say that hasn't already been said elsewhere so I'm not missing much.

As far as I see, not one single accusation currently being slung at Brueckner in the law courts (allegedly) is fit for purpose.  Just trumped up charges to satiate the ever hungry press and media.

I for one don't believe a word of it but if someone, anyone, can provide compelling evidence of the said crimes I will be all ears, until then consider me the ultimate sceptic!

I'm also finding the alleged court proceedings very curious to say the least - none of it adds up to anything even close to a reality.  Something is just not quite right with this whole affair - even the convicted rape charge is highly suspicious.

As with the disappearance of Madeleine McCann I guess we'll never know the truth.

Meanwhile as I think I've said before, the entire Portuguese investigation has been thrown to the wolves in favour of some previously unknown clown by the name of Christian Brueckner.  Who incidentally, hasn't been charged with anything relative to Madeleine McCann's disappearance simply because, I strongly suggest, there just isn't anything.

ETA:  The entire history of Christian Brueckner alleged crimes appears to hinge on the words of a convicted felon, Helge Busching and a fistful of other small time crooks.  I've seen mention of past crimes, some comparatively petty and some potentially horrendous but never have I seen any compelling evidence of said crimes ever having been committed.

Too many names have come and gone over the years, they never amount to anything but a distraction.

so that explains cb will not be a true walk out free guy if there is no conviction in these 5 cases during this trial, but because they use a certain period of time to let them part time out to reintegrate in society, that could be a bit translating into free before christmas.

i had seen many words about when the jailtime of 7 years in the 2005 rape case would end, but it is always nice to hear it from the defence too.

quite the horrible job, when you have to be the days in court, and only get still some sentences together to sell it as a story. at least half of the pieces are simply more of a mantra telling this is not about madeleine, do they really think you need that made known after well over 20 days.

and all the news outlets of the lesser gods of news are only just started to publish their nicked stuff.

it cannot be expected to not have to read made news about the guy before courts had its holidays too. we can only hope....

yes, the list of maybe this one, or the that one is very long, but more through the media than through law enforcement. most never got that long of an attention span so most are long forgotten. cb is only the 4th who made it to arguido status as suspect, there been more given the arguido status at the time operation grange wanted to talk to some guys, but that was more to give them some extra rights to defend themselves, they at least never been named as suspects by the portuguese prosecution.

and it is impossible to find out if cb is still arguido in portugal, based on the common rules about it, it could be a no, but there are ways to escape that with a special order. germany did not even got that far in the madeleine case, suspicion , but still no charges. without charges it has no use to listen to the musings of the prosecution service in braunschweig. without charges is is an empty load.

most people will react based on the emotions in the victims in the 5 cases, or better 3 out of 5. but based on facts all these cases are very weak.

the eye doctor seems to bring on a extra element to even have a much lesser connection between the 2005 rape case, if blue eyes in minimal light conditions are simply still be seen as blue, that is a big difference between the 2004 and 2005 rape cases, because the victim in the 2005 rape case talked specifically about dark eyes. and this expert-witness said blue keeps visible as blue, all others just seem dark.

3 other cases in portugal with a similar mo that have been solved must mean there are others who can have done the same.

so if only a pair of blue eyes are still standing to identify cb makes it very weak.

i am still looking for information that i read some time ago, that at the time of the 2004 rape case that was around an international football match. if i remember it correctly that was used to explain how hazel could recognize a german accent.

if she worked during that time, hearing and learning to recognise an accent would be easier. germans are never been rare in the algarve. this trial only seen a small part of them. and it can be hard to truly recognise a german accent in english from that of a dutch or danish person. may to september it is still a popular holiday destination. and all have quite a few who even live somewhere there some settled, others simply more just where the day let them end up.

blue eyes are not very rare in europe too. so that can hardly be a true sign for identification, and it seems that case only rests on that. the horrific story does not change that.

This is probably the trial in Braunschweig, which triggers the biggest media coverage this year: Christian B. is the main suspect of the public prosecutor's office in the Madeleine McCann case – and therefore in focus since 2020. However, he stands before the Braunschweig district court now because he is accused of various sexual offences.

i was already looking out on both the websites, but the prosecution had not even reacted on the first blow, about the still sitting judges, and nothing at all about the third judge member, it all was out as a juridical rumour earlier.

so nothing does change, the trial will still go on. i get the idea the germans do not have the usual possibility to retract the trial, so it would be safe for retrial later on without double jeopardy. there always is a possibility of an appeal against a verdict, but based on the witnesses, the majority has not even be a witness to anything in the 5 cases itself, just a lot of character downgrading.

the english sources seem to be only great in myth building activity. still it has all to happen in a german court.

This is probably the trial in Braunschweig, which triggers the biggest media coverage this year: Christian B. is the main suspect of the public prosecutor's office in the Madeleine McCann case – and therefore in focus since 2020. However, he stands before the Braunschweig district court now because he is accused of various sexual offences.

It's doubtful if anyone outside of Germany would have been aware of the name Christian Brueckner if that of Madeleine McCann wasn't so heavily promoted.

Where is the evidence?

the evidence must be of the same modern concrete quality, so it is there, touch it end you end up with just a lot of dust.

but germans do not need evidence that hard, they think it is nice if they have it, but they have still the possibility to try it to get through a court as what translated into indications process, indizien prozess.

what can end up by throwing just as much dirt on a person, until enough does stick and they must be seen as guilty. usually you have no need of so much witnesses that mostly have spoken from a personal opinion, not from facts at all. like all the former girlfriends, ex 'friends' and helping hands in other crimes.

and the understanding of indications goes very far. like a fingerprint found on a weapon, that still is not true evidence, but the thinking process from leaving the fingerprint means it was the owner of it that used the weapon to kill someone.
dna is in most cases also not evidence, but an indication that you can have left it there behind.

the fingerprint and dna are here indications, and in a indizien prozess german style is more the thinking process that connects it to the defendant.

other things can indeed be stories about habits, that can be part of a thinking process that these habits show equal points into the cases at hand.

still it has a much higher chance to become a mistrial or an unsafe conviction.

and when it is about thinking in this trial about the 5 cases, and the activity of the prosecution, it can easily land in thinking their best bullets already been fired in court. they can know, they build the files. so if they know already they only have much softer stuff left it could lead to an unproven verdict easily.

but it is always the prosecution that decides a case have an can go before the courts under the law of punishments.

and it cannot be hard for the judges to understand these 5 cases are in itself are not what is at stake, but just giving accreditation to a lot of witnesses and materials if there ever will be a case about madeleine.
and using them to keep cb in jail is also not in line with the law.

the prosecution can hardly not have known upfront how weak the material from the raid on that old boxfactory was. and that does answer why there never was a case started about that, even when it was in a different german state.

and all who have read in the pj files get a pretty sound idea of what is not there to make use of, so in the madeleine case it can hardly get beyond a lot of indications by story telling.

there is in the back ground also the arrest of that frank s. the undertaker for buying and selling childporn. but the few lines from a chat must have been leaked out, it is simply not usual a police force or the prosecution would hand that oud to a member of the public or the media. but it was said there was a case against that frank guy, but nothing against cb.

but it is a shame this trial is even happening, no german cases in the first place, and they have quite a back log in domestic cases in niedersachsen, so to see hours and costs go up in these 5 cases, that never been there on their own merit, none of them ever would have been given any looking into if indeed there was not that madeleine case in the back ground.
so the victims in these cases are only abused as tools, and that is not something you want to see happening.

it never was and cannot be more than betting on a very lame horse, that would never start the race for real.

these things that in germany the prosecution would or even could not bring a case to court if it was a sure win. that is simply stupid, because that is not how the court works, if that was really true, the prosecution would always win each case.
and that is not realistic or ever will become that.

but at least and by tradition the germans are again much better, in bungling, but i think , they would not say it all to loud this time.

and all that media attention, that is fond of letting their public believe these cases need to be solved, forget that, a solved case will hardly sell papers, but an unsolved one always can get a fresh 'maybe he dunnit' and the pages still have to be filled.
